Privacy Policy and protection of personal data communicated by the user when using the MeteoLux application

The personal data communicated directly or indirectly by the user in the context of the use of the MeteoLux application (hereinafter "app") shall be processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, as well as with the law of 1 August 2018 on the organisation of the National Commission for Data Protection and on the implementation of the above-mentioned Regulation (EU) 2016/679.

Identity of the controller

MeteoLux is a department of the Air Navigation Administration (ANA), 4 route de Trèves, L-2632 Findel, placed under the authority of the Ministry of Mobility and Public Works and responsible for handling your personal data (hereafter "MeteoLux).

 Subcontractor

The Government IT Centre (hereafter "CTIE") is the subcontractor of MeteoLux, department of the Air Navigation Administration (ANA). It is responsible for the hosting of personal data without having a right of access to the concerned data.

The company "Explose”, external service provider, is responsible for the development, deployment as well as the maintenance of the app.

Security measures

The CTIE and MeteoLux take various technical and organisational security measures to ensure an appropriate level of confidentiality, integrity,  and resilience of the services provided through the app, and to protect users' rights and freedoms in keeping with industry standards.

The user agrees that authorised persons may access his/her personal data collected for legitimate reasons.

Purpose of the data processing

The data will only be processed for the purpose of allowing the user to benefit from the app's service which consists for the user to indicate meteorological conditions from an exact position as well as to get local push notifications corresponding to the nearest city.

This requires the user to enable the mobile phone's geolocation data.

Collected data

Personal data is only ever collected, exported from the mobile phone, and processed via the app when the "crowdsourced observations” service is used. All other features of the app are not concerned.

The personal data collected from the user are their geographical location data, the date/hour of the observation as well as, cursor the index of the chosen icon.

This collection of data is permitted and justified by the consent expressed by the user for the processing of their data.

Consent

The processed data is internally dealt with by duly authorised persons, within the limits of their respective activities.

The user agrees that the data mentioned above is shared with the institutional partners (ministries, administrations) as well as subcontractors.

Data storage

Unless otherwise stipulated by this privacy policy and/or these T&Cs, the user's data is stored in the Grand Duchy of Luxembourg.

Security and Retention period of the data

The personal data collected by the app are processed by MeteoLux, as data controller, taking into account the legislation applicable to data protection.

MeteoLux is committed to implementing technical and organisational security measures to ensure the protection of personal data emerging with the use of Information systems.

The user's personal data will be kept for a period of 1 week.

User rights

The user has the right to access, rectification and erasure of data concerning them. They should contact the data controller in order to exercise these rights.

Users also have the right to restrict processing of their personal data, to object to its use, to withdraw their consent, and the right to data portability. These rights can be exercised by contacting the data controller directly.

Complaints

Users may address claims pertaining to protection of their personal data to MeteoLux, to the following address info@meteo.public.lu.

In addition, users may refer to the National Commission for Data Protection in relation to any dispute arising in this area.
